By accessing our website, submitting an enquiry, booking a service, or otherwise using our offerings, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

2. Definitions

For the purposes of these Terms:

• "Services" means construction and demolition (C&D) waste collection, transportation, recycling, processing, supply of recycled materials, compliance reporting, and related consultancy services.

• "Waste" means construction and demolition debris, rubble, concrete, bricks, soil, murum, and other materials accepted by us for processing.
• "Portal" means any digital interface, website, or application operated by us for service requests, tracking, or reporting.

3. Description of Services

Recre8 India provides environmentally responsible C&D waste management solutions, including but not limited to waste collection, GPS-tracked transportation, mechanical crushing and screening, washing and grading, manufacturing of recycled products, and delivery of certified recycled aggregates, M-sand, bricks, paver blocks, and filling materials.

We also assist clients with regulatory documentation, waste diversion certificates, ESG reporting, BRSR disclosures, and compliance with applicable C&D Waste Management Rules.

Specific service terms, pricing, schedules, and acceptance criteria will be confirmed through quotations, work orders, or signed agreements.

4. Eligibility and Account Registration

By using our Services, you represent that you are at least 18 years old and have the legal authority to enter into binding contracts on behalf of yourself or your organisation.

You agree to provide accurate, current, and complete information during registration or enquiry submission. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

5. User Responsibilities

When using our Services, you agree to:

• Provide accurate and truthful information regarding waste type, quantity, source location, and project details.
• Segregate waste at source as instructed and avoid mixing hazardous, biomedical, chemical, or prohibited materials with C&D waste.
• Ensure safe and lawful access to collection sites, including necessary permissions, clearances, and labour safety measures.
• Comply with all applicable laws, including C&D Waste Management Rules, 2016, environmental regulations, municipal bylaws, and labour laws.
• Make timely payments as per agreed quotations and invoices.

6. Prohibited Activities

You may not:

• Use our website or Services for any unlawful, fraudulent, or unauthorised purpose.
• Submit false, misleading, or incomplete information about waste or project details.
• Interfere with or disrupt our website, servers, networks, or security systems.
• Attempt to gain unauthorised access to any portion of our systems or other users' accounts.
• Reverse engineer, copy, scrape, or misuse any content, software, or data from our website.
• Engage in any activity that could harm our reputation, operations, or third-party relationships.

7. Quotations, Pricing, and Payments

Service quotations are valid for the period specified therein and are based on the information provided by you. Final pricing may vary depending on actual waste characteristics, quantity, location, access conditions, transportation distance, and applicable taxes.

All prices are quoted in Indian Rupees (INR) unless otherwise stated and are exclusive of applicable GST, duties, and government levies unless expressly included.

Payments must be made as per the terms stated in the invoice. We reserve the right to suspend or refuse Services in case of delayed or disputed payments.

8. Cancellation and Refund Policy

Service bookings may be cancelled or rescheduled subject to prior written notice and our confirmation. Cancellation fees may apply depending on the stage of service and resources already deployed.

Refunds, if applicable, will be processed in accordance with the specific terms agreed upon in the quotation or service contract. Advance payments are generally non-refundable unless otherwise agreed in writing.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, designs, software, and trademarks, is the property of Recre8 India or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the website for personal or internal business purposes. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Recre8 India shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of our website or Services.

Our total liability for any claim arising from these Terms or the Services shall not exceed the amount paid by you to us for the specific service giving rise to the claim during the three months preceding the event.

You agree to indemnify, defend, and hold harmless Recre8 India, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising out of:

• Inaccurate or incomplete information provided by you.
• Mixing hazardous or prohibited materials with C&D waste.
• Any third-party claim arising from your use of the Services.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, riots, war, terrorism, transportation disruptions, or severe weather conditions.

13. Termination

We may suspend or terminate your access to our website or Services at any time, with or without notice, if we believe you have violated these Terms or applicable law, or if such action is necessary to protect our interests or those of third parties.

Upon termination, all provisions that by their nature should survive termination shall continue to apply, including intellectual property, indemnification, limitation of liability, and dispute resolution.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
